Terms and Conditions

Jelen általános szerződési feltételek („ÁSZF”) a Szabadulószoba Kft. („Üzemeltető”) által működtetett GamekaLand (címe: 1065 Budapest, Nagymező utca 68.) igénybevételére és a https://gamekaland.hu honlap használatára vonatkozó feltételeket, a felek és a velük érkező további vendégek („Felek”) jogait és kötelezettségeit tartalmazza.

The detailed, practical, and safety rules for the use of GamekaLand are contained in the House Rules ("House Rules"), the provisions regarding the processing of personal data of the Parties are contained in the "Data Management Information," and the information regarding cameras is contained in the "Information on the Operation of Cameras," which are annexes to the GTC ("GTC and annexes together: "Contract").

Guest: An adult who actually uses the services of GamekaLand and can prove that they are at least 18 years old with an identity document.

Reservation: Guests can use the services of GamekaLand by prior appointment.

Service: GamekaLand is Hungary's first facility for team competitions. Guests can use the games, equipment, and other facilities on the GamekaLand premises for entertainment purposes during activities led by GamekaLand staff. The Guest is obliged to become familiar with and adhere to the pre-game information and safety rules.

  1. Validity of the Contract:

The Contract is concluded for an indefinite period in the absence of a different agreement between the Parties.

The place of performance of the services provided under the Contract is Hungary, 68 Nagymező Street, Budapest, 1065, ground floor and first floor area.

The Contract between the Parties is concluded for the first time at the time of booking and then upon entry to the premises.

Az időpontfoglalás véglegesítésekor Vendég köteles elfogadni az Adatkezelési Tájékoztatót, a jelen Általános Szerződési Feltéteket és a Házirendet és ezeket köteles megismertetni minden vele érkező Vendéggel. Vendég nyilatkozik továbbá, hogy tudomásul vette és elfogadja a GamekaLand csoportos fénykép és videófelvételek készítését és Üzemeltető általi felhasználását; valamint nyilatkozhat hírlevél fogadására vonatkozóan is.

After booking an appointment, the system sends a confirmation email to the Guest.

  1. Rules of Reservation:

A - General Rules

Access to the GamekaLand premises is only possible by prior appointment or by phone during opening hours, and unlimitedly through the website.

B - Reservation via the Website and Advance Payment:

Időpont foglalásakor a https://gamekaland.hu/ oldalon ki kell választani a szolgáltatás típusát (pl. adrenalin, FunFusion, Dupla Élvezet), az érkező Vendégekkel folytatott kapcsolat típusát, a foglalni kívánt napot és időpontot.

Reservations can be made for up to 8 people through the website.

In the case of booking for multiple people, the Guest making the reservation is responsible for paying the full ticket price, regardless of the persons participating in the game and the settlement between them, and is obliged to inform the accompanying Guests about the terms of use specified in section D.1.

After providing the booking details, the Guest must provide the additional data required for payment (full name, email address, phone number, billing address), and also accept these GTC and the house rules.

The Operator is not responsible for any errors that may occur during credit card payment. The Guest is responsible for ensuring that they are entitled to use the payment method and device provided, and that the payment details provided are true and accurate. The Guest is liable for any damage arising from the inaccurate or incorrect provision of email address.

After completing the payment, the following data of the purchase are visible: booking ID and time of booking.

If the reservation and purchase are successful, the Operator will send a confirmation email to the email address provided during the booking process. If the Guest does not receive the confirmation email within 2 hours and does not find it in the spam folder or junk mail folder, they should contact Customer Service (https://gamekaland.hu/contact/).

 The confirmation email serves as confirmation of the reservation and the commencement of the service.

The Guest must present the confirmation email upon entry, which can also be done via phone.

The Guest will receive an electronic invoice for the purchase via email within 24 hours.

C - Reservation by Phone or On-site:

It is also possible to make reservations by phone or on-site.

On-site, service selection, scheduling, and service purchase can be done in cash or by bank transfer at the cash desk.

The provisions regarding the acceptance of the terms of use (see point D.1) also apply in these cases.

D - Check-in:

Vendég a foglalt időpontjára pontosan kell hogy érkezzen, hogy a játékokat időben megkezdhesse.

At the time of admission, the Operator is entitled to verify whether the following conditions are met:

The Guest is at least 18 years old and can prove it with a valid document.

The Guest possesses a valid confirmation email.

The Guest has paid the deposit and accepted the Operator's General Terms and Conditions.

The Guest is in a balanced physical and mental condition.

The Guest weighs no more than 130 kg.

The Guest has the necessary change of clothes for use.

GamekaLand can only be used if the above conditions are met. In their absence, the Operator may refuse admission.

If the Guest arrives late for the reservation time, and as a result, the game can only start late, this does not affect either the end time or the amount of the Service Fee.

  1. Service Fee:

The services of GamekaLand can be used after booking, with a confirmation email in hand. The types and prices of services are available on the website (https://gamekaland.hu/arak/) and at the GamekaLand cash desk, and - in the case of online booking - on the website used for booking.

The Guest pays 30% of the total service fee as a deposit when booking through the website.

The remaining amount of the total service fee must be paid on-site by the Guest before using the Service. Payment can be made in cash or by bank transfer on-site.

For individual requests, larger groups, corporate events, contests, coupon offers, etc., the Operator is entitled to determine the prices for the use of GamekaLand differently or individually.

The Service Provider reserves the right to change the prices listed on its website at any time. The prices listed are gross prices and include the amount of VAT.

  1. Use of GamekaLand:

A - Compliance with the House Rules

During the use of GamekaLand, the Guest is obliged to comply with the rules of the House Rules and the instructions given for the respective games. The House Rules are available at https://gamekaland.hu/hazirend/.

In the event of a breach of the House Rules, the Operator is entitled to stop the game and/or exclude the Guest who violated the rules from the premises of GamekaLand without refund.

By accepting these GTC, the Guest undertakes not to use the Service to harass, defame, slander, or otherwise violate the personality and other rights or legitimate interests of third parties.

B - Individual Liability:

The Guest uses the game equipment at GamekaLand at their own risk. The Guest acknowledges the risks and hazards arising from the use of the services upon entering the GamekaLand premises at the latest. By accepting these GTC, the Guest declares:

I acknowledge that participating in the competitive games of GamekaLand or related activities, using equipment and services entails risks and hazards.

Participating in the games of GamekaLand or related activities can unusually strain the body and is not recommended for individuals with asthma, epilepsy, heart failure, respiratory disorders, high blood pressure, bone, cartilage, ligament problems, or unstable mental condition.

It is expressly contraindicated and prohibited for pregnant or potentially pregnant women, as well as for persons under the influence of alcohol or other psychoactive substances, to use the games of GamekaLand!

I am aware that if there are any questions about my health condition, I need to consult my attending physician. I have been provided with comprehensive information about the services of GamekaLand, equipment, and facilities operated by GamekaLand, and I have had the opportunity to ask questions about them if any arose. I am fully aware of all kinds of risks associated with using the services, equipment, and facilities of GamekaLand, including but not limited to:

1. Any injury, including serious injuries and death, that may occur during the use of the services, equipment, and facilities provided by GamekaLand, including but not limited to: stumbling, loss of balance or slipping leading to falling onto temporarily or permanently placed equipment, the floor, people, or objects; injuries resulting from the incorrect use of protective equipment or the failure to wear protective equipment; injuries resulting from careless use of equipment; as well as any other injury that may occur during the use of the services, equipment, and facilities provided by GamekaLand for any other reason.

2. Injuries attributable to the activities or omissions of others, including but not limited to: injuries caused by slipping, stumbling, falling, or using equipment by others.

3. Cuts, abrasions caused by broken objects, game equipment, or any other surface, person, or equipment.

4. Shock, stress, or any other injury caused by any other health factor.

5. Exacerbation of any existing illness, injury, or other health condition.

6. Incorrect use or failure to use any protective equipment or other equipment.

7. Non-compliance with instructions provided by GamekaLand employees or failure to seek assistance with any arising questions.

8. Any injury that may occur during the stay in the premises for any reason, including but not limited to: slipping, stumbling, falling, and any other injury arising from the risks associated with the use of the services, equipment, and facilities provided by GamekaLand or the activities organized by GamekaLand.

I acknowledge that the above-mentioned possibilities do not cover all possible risks. I acknowledge that risks not listed do not in any way affect the extent of these risk, exemption, and compensation. My participation in the activity is voluntary, and my decision remains unchanged despite the risks listed here. I confirm that I have appropriate insurance coverage to cover injuries and damages incurred or caused by participation. I also certify that I do not have, or at least am not aware of, any health or physical conditions that would affect the safe use of the services, equipment, and facilities provided by GamekaLand. If any such condition arises, I am willing to accept and bear all risks indirectly or directly arising from it.

My participation in the activity is voluntary, and my decision remains unchanged despite the risks listed here. I confirm that I have appropriate insurance coverage that covers injuries and damages caused or suffered as a result of participation here. Furthermore, I certify that I do not have, or at least I am not aware of, any health or physical condition that would affect the safe use of the services, equipment, and facilities maintained by GamekaLand. If any such condition arises, I willingly accept and bear any indirectly or directly resulting risks.

VII. Breach of Contract, Liability

The Operator makes every reasonable effort to operate the Service safely and in compliance with regulations, but shall not be liable for any losses or damages caused by the failure of the equipment, structures, or other deficiencies provided by the Service.

The Parties expressly exclude the Operator's liability for damages under Section 6:143 (2) of the Civil Code, regardless of whether such damages may be caused by the Operator's breach of contract or otherwise. This limitation of liability does not affect liability for intentional breach of contract causing loss of human life, bodily integrity, or health (Section 6:152), as well as liability for intentionally causing damage to human life, bodily integrity, or health (Section 6:526).

The Operator is not liable for the flawless and uninterrupted operation of the Service and/or online platforms usable for booking and payment. However, the Operator is entitled to suspend the operation of such platforms or even GamekaLand itself for the purpose of development, modification, or maintenance.

The Guest may only use the Service at their own risk. The Operator is particularly not liable for the behavior of other guests.

The Operator reserves the right to refuse the Guest's reservation in justified cases, including providing false or incomplete information, or in case of any abuse during the use of the Service or in connection with the confirmation email.

If it is suspected that the Guest is not using the GamekaLand equipment, props, or objects in accordance with the contract, the Operator is entitled to immediately prohibit the use of GamekaLand and ban the Guest. In justified cases or at the explicit request of the Guest, the Operator will draw up a record of such an event.

The Guest must not compromise the security of online platforms used for booking and payment. Such behavior may result in civil and criminal sanctions. The Guest undertakes not to use any device, software, or procedure that disrupts or attempts to disrupt the proper functioning of the online platforms for booking and payment, or any activity on the Operator's website.

Guests are fully liable for any damage caused by the proper and intended use of GamekaLand games and equipment. The Operator excludes all liability arising from improper or unlawful use of GamekaLand. In the event of damage to these and/or the set, the Guest is obliged to compensate the damages (material damage and loss arising from delay) to the injured party.

The Guest is obliged to fully indemnify any damage caused to third parties during the use of GamekaLand resulting from the Guest's behavior or omission. This indemnity obligation extends to any type or nature of claim, expense arising from any demand, deficiency, damage, lawsuit, or other official procedure, procedural costs, and attorney fees.

For technical reasons related to liability insurance, any claim for damages must be reported immediately on the spot, along with the preparation of a report – together with the staff; furthermore, the claim must be specified and quantified in writing within 6 months.

VIII. Data Management

The Guest acknowledges that the Operator processes the data provided or known by the Guest in connection with the Service in accordance with the provisions of the Data Processing Information, and declares that they have the consent of the Data Subjects regarding the personal data provided (including personal data of third parties participating in the game).

The Guest acknowledges that the Operator has placed cameras in a certain gaming room on the GamekaLand premises for electronic surveillance purposes as part of the service.

By making a reservation and entering the GamekaLand premises (or by behavior implying it), the Guest consents to the Operator taking group photos, group or panoramic videos as part of the service and using them on the Operator's online platforms (website, Facebook, Instagram, TikTok, YouTube, Google+).

Upon consent (subscription), the Operator sends newsletters to the email address provided by the Guest regarding the Operator's events, promotions, and interesting information.

  1. Modification of Contract

After purchasing the Service, the Guest is entitled to modify the purchased service and select a new time slot from the available free slots within 7 days prior to the Booking date, under the same conditions. Only the Booking date can be modified, and it is not possible to convert a ticket to a voucher or change its type or duration.

It is not possible to modify the Booking date within the last 7 days prior to the Booking date.

Only the Guest who managed the booking can modify the time slot, and the Guest can only modify the time slot by phone.

Given that the legal relationship between the Parties is established on a specific day for a specific duration of play based on this Agreement, the Operator reserves the right to unilaterally amend the provisions of this Agreement in relation to the operation, use, opening hours, entry conditions, and fees of GamekaLand for the future. Such modification does not affect already purchased Services.

The Operator announces changes to the GTC and the price of the Service on its website.

  1. Withdrawal, Termination of the Contract

The Guest may withdraw from the purchased service and request a refund of the deposit within 7 days prior to the Booking date.

In the event of withdrawal within 7 days prior to the Booking date, the Guest forfeits the deposited deposit and cannot request a refund.

A Guest qualifying as a Consumer, who purchased the Service price online on the GamekaLand website and the booked time slot falls within 7 days, is also not entitled to a withdrawal right or termination right, given that this Agreement is a contract related to leisure activities, where a fixed performance deadline (Booking date) was specified.

If the service is missed for any reason, GamekaLand will notify this on its website (https://gamekaland.hu), and Guests will be informed by email and telephone if possible, and about the possibility of redeeming the purchased service or further use.

  1. Complaints, Dispute Resolution, Jurisdiction Clause

The Guest can make a verbal complaint, which the Operator will immediately investigate. If the Guest disagrees with the handling of the complaint or immediate investigation is not possible, the Operator will make a record of the complaint and its position and hand over a copy of it to the Guest on the spot in case of oral complaints or, in case of verbal complaints communicated by phone or other electronic communication service, will send it to the Guest at the latest together with the substantive response in point XI.2. via electronic message or by post in writing. The Operator and the Guest primarily settle their disputes out of court through negotiation.

In the event of a dispute between the Operator and the Guest, the complaint can be made in writing to info@gamekaland.hu or to the postal address, which the Operator will investigate, and inform the Guest in writing or electronically about the result within 30 days at the latest. The Guest is entitled to request negotiation in writing from the Operator within 8 days of receipt of the response if they do not accept what was stated in the Operator's information. If the negotiation, within 14 days from the receipt of the Guest's request by the Operator, does not

In the event of a consumer dispute, the Guest is entitled to contact the conciliation board competent according to their place of residence or stay. The contact details of the conciliation boards, including their addresses, phone numbers, websites, and mailing addresses, can be found on the https://bekeltetes.hu/udvozlo website.

If the Guest's consumer rights are violated, they can file a complaint with the consumer protection authority competent according to their place of residence. The contact details of these authorities can be found here: http://jarasinfo.gov.hu.

XII. Other Provisions

According to the Copyright Act of 1999 (Act LXXVI of 1999), the Operator's website (https://gamekaland.hu) is considered a collection work as a unique compilation, and thus the website and all content placed on it are protected by copyright. It is prohibited to use the external appearance of the website as a work of visual art created with computer graphics, the software of the website, its texts, and regulations without the written permission of the Operator, as well as using any application that can modify the website or any part of it. Any material from the website and its database can be taken with the written consent of the Operator, with a reference to the website and indicating the source. The copyright holder is the Operator.

The current text of these GTC is available and can be downloaded from the Operator's website (https://gamekaland.hu/altalanos-szerzodesi-feltetelek). A copy of the GTC, effective at all times, is displayed at the Operator's reception for viewing.

For questions not regulated by this GTC, the provisions of the Civil Code (Ptk.), Government Decree 45/2014 (II.26.) on contracts concluded between absentees, and Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society, as well as other relevant legislation, shall apply.

XIII. Ajándékutalvány felhasználási szabályzat

Az ajándékutalvány megvásárlásával és felhasználásával a vásárló és a felhasználó elfogadja az alábbi szabályokat és feltételeket:

  1. Érvényesség

Az ajándékutalvány érvényességi ideje a kiállítás dátumától számított 12 hónap (pontos lejárati dátum feltüntetve az utalványon).

Az érvényességi idő meghosszabbítására a vevő részéről nincs lehetőség.

Az ajándékutalvány beváltására rendelkezésre álló időtartam automatikusan meghosszabbodik azzal az időtartammal, amely alatt az üzemeltető hibájából eredően a szolgáltatás igénybevétele ellehetetlenül. Ilyen akadályozó körülménynek minősül különösen, de nem kizárólagosan, az üzemeltető által elrendelt, 2 hétnél hosszabb ideig tartó ideiglenes zárvatartás.

  1. Felhasználási terület

Az ajándékutalvány kizárólag a GamekaLand által nyújtott program keretein belül használható fel.

Az utalvány készpénzre nem váltható, és részleges felhasználás esetén sem jár visszatérítés.

  1. Foglalás és időpont-egyeztetés

Az utalvány felhasználásához előzetes időpontfoglalás szükséges.

Foglalás kizárólag telefonon vagy e-mailben lehetséges, az utalvány sorszámának megadásával.

Foglalás lemondása vagy módosítása legkésőbb 72 órával az esemény időpontja előtt lehetséges.

  1. Részvételi feltételek

Az ajándékutalvány egyszeri belépésre jogosít a megjelölt eseményen.

Részvételre kizárólag az utalványon szereplő létszámú csoport jogosult.

Az eseményen minden résztvevő köteles betartani a GamekaLand házirendjét.

  1. Átruházhatóság

Az ajándékutalvány átruházható, de a felhasználó köteles betartani a jelen szabályzatban foglaltakat.

  1. Elveszett utalványok

Az elveszett vagy megsemmisült ajándékutalvány pótlására nincs lehetőség.

Az ajándékutalvány más kedvezménnyel vagy akcióval nem vonható össze.

Fenntartjuk a jogot a játékok és programok változtatására. Amennyiben az utalvány egy korábban még elérhető játékprogramra vonatkozott, úgy annak vásárlási összegével megegyező játékcsomagra vagy játékcsomagokra váltható be.
